Welcome to PDBuilder (“PDBuilder,” “we,” “us,” or “our”). PDBuilder is an educational platform designed to help individuals and organizations learn product development concepts, frameworks, and best practices.

PDBuilder is a product and brand of Smartware Advisors, LLC.

By accessing or using PDBuilder, you agree to these Terms of Use (“Terms”). If you do not agree, do not use the platform.

 


 

1. Educational Purpose Only

PDBuilder is a learning and educational tool only.

  • PDBuilder does not provide professional services of any kind.

  • Content, outputs, recommendations, templates, examples, or analyses generated by PDBuilder are for educational and informational purposes only.

  • PDBuilder does not provide engineering, legal, regulatory, medical, safety, financial, or compliance advice.

You acknowledge that PDBuilder is intended to support learning and understanding — not decision-making for real-world deployment.

 


 

2. No Responsibility for Products or Outcomes

PDBuilder does not design, engineer, manufacture, test, validate, certify, approve, or deploy products.

You agree and acknowledge that:

  • PDBuilder is not responsible for:

    • Financial loss or business impact

3. High-Risk and Regulated Domains (Blanket Disclaimer)

PDBuilder may be used to learn about domains that are inherently high-risk or heavily regulated, including but not limited to:

  • Medical devices and healthcare

  • Automotive and mobility systems

  • Robotics and autonomous systems

  • Aerospace, aviation, and drones

  • Energy, infrastructure, and industrial systems

  • Safety-critical or human-impacting products

PDBuilder does not ensure safety, regulatory compliance, or suitability for use in any of these domains.

Use of PDBuilder in connection with such domains is at your own risk.

 


 

4. User Eligibility (18+)

You must be at least 18 years old to use PDBuilder.

By using the platform, you represent and warrant that you meet this requirement.

 


 

5. Free and Paid Access

PDBuilder may offer:

  • Free educational features

  • Optional paid upgrades or premium features

Paid features do not change the educational nature of the platform and do not create any professional, advisory, or fiduciary relationship.

All payments are subject to separate pricing and billing terms displayed at the time of purchase.

 


 

6. User Responsibilities

You agree to:

  • Use PDBuilder lawfully and ethically

  • Comply with all applicable laws and regulations

  • Independently validate any output before acting on it

  • Assume full responsibility for decisions made using PDBuilder insights

You understand that AI-generated outputs may be incomplete, inaccurate, outdated, or based on assumptions.

 


 

7. Prohibited Use

You may not use PDBuilder to:

  • Engage in illegal or fraudulent activity

  • Circumvent safety, security, or compliance obligations

  • Misrepresent PDBuilder outputs as certified, approved, or professional advice

  • Infringe intellectual property rights

  • Upload malicious code or attempt to compromise the platform

  • Misuse the platform in ways that could cause harm to people, property, or systems

We reserve the right to suspend or terminate access for violations.

 


 

8. Confidential and Proprietary User Data

You may submit proprietary, confidential, or sensitive information while using PDBuilder.

  • You retain ownership of your content

  • You are responsible for ensuring you have the right to submit such data

  • PDBuilder processes user data solely to provide platform functionality

PDBuilder is not responsible for decisions made based on user-submitted data, including incomplete or inaccurate inputs.

A separate Privacy Policy governs data handling practices.

 


 

9. No Warranties

PDBuilder is provided “AS IS” and “AS AVAILABLE.”

We disclaim all warranties, including but not limited to:

  • Accuracy or completeness

  • Fitness for a particular purpose

  • Non-infringement

  • Availability, uptime, or error-free operation

We do not guarantee that outputs are correct, safe, compliant, or suitable for any real-world use.

 


 

10. Limitation of Liability

To the maximum extent permitted by law:

PDBuilder and its founders, operators, affiliates, and partners shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to:

  • Product failures

  • Safety incidents

  • Regulatory actions or penalties

  • Business interruption

  • Loss of revenue, data, or reputation

Your sole remedy is to discontinue use of the platform.

 


 

11. Indemnification

You agree to indemnify and hold harmless PDBuilder and its affiliates from any claims, damages, losses, or expenses arising from:

  • Your use of the platform

  • Products or services you create

  • Violations of these Terms

  • Violations of law or third-party rights

 


 

12. Intellectual Property

All PDBuilder content, frameworks, workflows, branding, and platform functionality are owned by or licensed to PDBuilder.

You may not:

  • Reverse engineer or extract proprietary logic

 


 

13. Third-Party Services and AI Models

PDBuilder may rely on third-party tools or AI services.

  • We are not responsible for third-party outputs or availability

  • AI-generated content may be inaccurate or incomplete

  • You are responsible for validating all outputs

 


 

14. Termination

We may suspend or terminate access at any time, with or without notice, if we believe continued use poses legal, security, or operational risk.

 


 

15. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Any disputes shall be resolved in courts located in California.
